General 

Welcome to GLOW Lingual Co.,Ltd. an online language company that offers a diverse online learning program (the “Service”). The Service is owned and operated by GLOW Lingual Co.,Ltd. (hereinafter: “GLOW Lingual”, “Service Provider, or “Company”). Furthermore, the present general terms and conditions of GLOW Lingual defines the conditions and related circumstances of using our company’s website as well as the learning platform available at www.glowlingual.com (hereinafter: “Platform”, “Website”, “Site”).

These terms of use, together with the following Privacy Policy at www.glowlingual.com, set forth the basis on which you are permitted to access and use each and all of our services provided to you (“Services)”.

Please read the Terms of Use carefully before using the Site and our services. By accessing and using the Site and services in any way, including, without limitation, browsing the Site, you expressly acknowledge and agree to and are bound by the Terms of Use described herein, and therefore waive any applicable rights to require a non-electronic original signature or delivery of non-electronic records, to the extent not prohibited under applicable law. The terms and conditions may be amended by us from time to time, which will take effect from the date the amendments are posted on www.glowlingual.com.

All references to “we,” ”us,” “our,” “service provider” and “our company” are to GLOW Lingual and our affiliated companies. All references to “client” are to the person who signs the Terms and Conditions and Privacy Policy and all references to “student” and/or “users” are to the person who the client designates to use the Services (including but not limited to the child of the client). All references to “you” and “your” are to the client, student and user. 

The site and service provided by GLOW Lingual is intended to be used by children. However, minors under the age of 16 shall not register an account on the Website. Minors shall only use the Website and Services with the approval and supervision of their legal guardian or representatives (e.g. parent, foster parent and etc.).

For as long as these Terms of Use are in effect and provided that you comply with our Terms of Use and applicable laws, we hereby grant you permission to use and access the Site. 

DESCRIPTION OF WEBSITE AND SERVICES 

GLOW Lingual provides age-appropriate online English lessons for children and teenagers. By attending the online classes on our platform, the children are able to learn English online individually or in groups with the help of our English teachers (hereinafter: “Teacher”), who are contractual partners of GLOW Lingual. 

GLOW Lingual also provides an Application and/or application of the third-party (who performs the services on our behalf) which allows the Users to schedule the online Classes for their children, as well as to monitor their children’s progress and to top up the balance of their User Account, and to get important notifications. GLOW Lingual provides the Users with the use of the Platform, including English Classes in return for payment (hereinafter: “Payment”), and the Users are able to choose from multiple Payment options offered by the company in accordance with their  preference. 

YOUR REPRESENTATIONS AND WARRANTIES

You represent and warrant to our company that you will procure that any and all students and/or users designated by him/her to use the Services will comply with the Terms and Conditions as well as acknowledge and give consent our Privacy Policy. In the event of any breach of this warranty, only the User or its legal representatives or legal guardian violating the warranty shall be liable for any and all damages and costs incurred thereof. 

You represent and agree to give consent to our company to have the rights to use the materials you created and/or own submitted via the Service and/or our Platform. You further represent and warrant the identification materials you submit to our company are true and accurate representations of legal identification documents. You also warrant that you will carefully safeguard your password, username, and account information, and will not share your password or username with any third party and will not allow any third party to access your GLOW Lingual account for any purpose.

You agree that our company shall not be liable for any damages arising from data wrongly and/or incorrectly given by the User, this includes but is not limited to the giving out of User’s email address and/or password available to unauthorized persons. The website, platform and Application (if any) may be used by any User solely at his or her own risk and under his or her own responsibility. 

You agree and give consent to GLOW Lingual staff to record a video and photo of the Classes for the purpose of quality control and service improvement and for the purpose of but not limited to investigating the claims of the Users. Furthermore, this is to enable students to re-watch and self practice the lessons. You also agree that some specific photos or videos may in some circumstances be submitted to the Teacher, state of authorities, court and related government sectors as legal grounds for such submission.

You agree to protect, defend, indemnify and hold our company and its directors, officers, employees, contractors, Teachers, agents, suppliers, licensors, successors and assigns harmless from and against any and all losses, claims, cause of actions, obligations, liabilities, and damages whatsoever, including but not limited to attorneys’ fees, arising out of or relating to your access or use of the Services, any false representation made to us (as part of these Terms and Conditions or otherwise), your breach of any of these Terms of Use and Terms and Conditions, and/or any claim that any translation we provide to you is inaccurate, inappropriate or defective in any way whatsoever. 

SITE CONTENT

Even though we make an effort to keep the Site Content published on our learning platform/website as accurate as possible we cannot guarantee that the Site Content will be at all times updated, accurate, reliable, complete or free of errors. We reserve the right, at any time and at our sole and absolute discretion, to edit, change, modify, delete and /remove any part of the Site Content, without being required to notify you of such changes made to the Site Content. Assessing and using the Site and the Site Content included therein is to be done at your own responsibility and risk. 

POSTING CONTENTS BY USERS

Our platform and/or the Site’s features may enable you to create and/or post content of your own and/or of the other users on our Site (“User Content”). We reserve the right to decide to post or not post your User Content on our Site, at our sole and absolute discretion and without any obligation to explain our decision. We do not guarantee that the User’s content will remain confidential, whether such User Content is published on the Site or not, and you are solely responsible for your User Content and posting it on the Site. We may at any time and at our sole discretion, edit, remove and monitor all the User Content you publish on our Site, without providing you with a notice in that regard. 

You understand and agree that by accessing and using the Site and our platform, you may be exposed to User Content of other users of the Site, which may be inaccurate, offensive, or indecent. We are not and shall not be responsible in any way for such User Content you may be exposed to, including but not limited to its usefulness, accuracy, safety, or intellectual property rights in and to such User Content, and you hereby waive any claim, right and remedy related to the above which you may have against our company, its directors and officers and anyone on its behalf. 

By submitting User Content to our Site, you hereby grant us an irrevocable, perpetual, non-exclusive, worldwide, sub-licensable and transferable license to use, copy, transfer, edit and prepare derivative works of the User Contents including distribution of your User Content and/or any part thereof in any media. To extent permitted by law, you hereby waive any moral rights with respect to your User Content. You also grant a non-exclusive right to all other users of the Site, to distribute, copy or create derivative works of your User Content or any part thereof in accordance with these Terms of Use. 

All ownership rights to the User Content you publish on the Site are retained by you. You also represent and warrant that you have all rights and permissions required in order to use and authorize others to use the Intellectual Property Rights (i.e. any and all rights, title, and interest, worldwide, in and to any and all parents, applicable laws and regulations) in and to the User Content you post on the Site. You are prohibited to post, submit, transmit or display any User Content which: 1) is protected by trade secret, copyrighted or subject to any rights of third parties 2) is misleading, deceptive or unfair pursuant to any applicable consumer protection legislation 3) is violating export control legislation or promoting in anyway an illegal activity 4) is threatening, defamatory, unlawful, harassing, hateful, pornographic, racially offensive, or otherwise promotes or encourages any illegal activity or is inappropriate 5) is creating a risk to the safety of general public or a specific person’s health or safety or otherwise interferes with any lawful investigations or 6) is fraudulent or malicious.

DISCLOSURE OF INFORMATION OBTAINED

We reserve the right to read, access and disclose any information obtained by us in connection with your use of the Site which we have reasons to believe is necessary or required in order to 1) comply with applicable laws and regulations, judicial decree, inquiry or request made by any governmental authority 2) investigate, prevent, restrict or otherwise handle any security or technical issues 3) investigate a potential violation of these Terms of Use or enforce any violation of these Terms of Use 4) protect the rights, safety and health of the general public or a specific person or 5) as required in order to provide you with technical support and administrative assistant.

EXPORT ADMINISTRATION LAWS AND REGULATIONS

You acknowledge and agree that materials on the Site, the Website, Learning Platform, the Services as well as the Applications (if any) including the company social media platform may be subject to certain export laws and regulations. Diversion of such materials contrary to any applicable export law and/or regulation is prohibited. You agree that none of the materials on the Site nor any direct product therefrom, is being or will be acquired for, shipped, transferred, or re-exported, directly or indirectly, to proscribed or embargoed countries or their nationals. 

PRIVACY POLICY

Any personal information (i.e. information which may be used to personally identify an individual, such as name, address, email address, phone number) which may be collected or obtained in connection with the Site, will be used in accordance with the Privacy Policy available on our Site. By consenting to these Terms of Use/Terms and Conditions you hereby agree to the provisions of the Privacy Policy and the way we use your personal information.

INTELLECTUAL PROPERTY PROTECTION

You agree that the Services, including but not limited to Content, logo, trademarks, service marks, graphics, user interface, audio clips, video clips, editorial content, the script, the software used to implement the Services; photos, sounds, designs, interactive features, articles, icons, texts, reviews, presentations, brochures, course catalogs, newsletter, descriptions, products, software, contain proprietary information and material that is owned by GLOW Lingual, our business partners and/or its licensors, and is protected by applicable laws, including but not limited to copyright. You agree to not use such proprietary information or materials in any way whatsoever except for the use of the Services for personal, noncommercial uses in compliance with these Terms and Conditions. No portion of the Services may be reproduced in any form or by any means, except as expressly permitted in writing by this agreement or by our company and the related licensors. You agree to not modify, rent, loan, sell, or distribute the Services or Content in any manner, and you shall not exploit the Services in any manner not expressly authorized. 

LINKS: THIRD PARTY CONTENT

The links to Third-Party websites, The Site, platform, and website may contain links connecting you to access and use content from our partners, contractors or third-party websites, all of which we do not own and have any control over. Third-Party Websites may include inaccurate, indecent or offensive content, and you are to be responsible for deciding to use the third-party links and website at your own risk and you are solely responsible for whatever use you make of these Third Party Websites, contents and their services. 

You acknowledge and agree that our company is not responsible in any manner for the content, services, features, privacy policy, terms of use, and other practices and policies of such Third Party Websites. By agreeing and consenting to these Terms of Use you hereby expressly release GLOW Lingual and its affiliates, directors, office holders, and anyone acting on its behalf, from any and all liability arising from your use of such Third-Party Websites or related services provided by the Third-Party. You agree to contact such Third-Party Websites directly. Therefore we encourage you to carefully read the term of use and their policy prior to accessing or using. 

NO UNLAWFUL OR PROHIBITED USE 

By registration or using our Site and Platform, the Users are obliged to provide their and their child’s data correctly. The User agreed to be liable for all damages and costs incurred by the Service Provider, the User or a third person as a result of the User providing incorrect data. 

You may not upload viruses or malicious code and may not display any behavior that overloads the Website, the learning Platform or the Application (if any), or makes them inaccessible, or prevents their operation.

You may not upload, display, or otherwise provide on or through the Services any content that is defamatory, abusive, threatening, harassing, hateful, harmful, invasive of another’s privacy, vulgar, false, intentionally misleading, trade libelous, pornographic, obscene, offensive, promotes racial bigotry, hatred or physical harm of any kind against any group or individual or otherwise violates any law or infringes upon the right of any third party (including but not limited to copyright, trademark, privacy, publicity or other personal or proprietary rights).

You may not and shall not: (1) use the Site for any purpose that is unlawful or prohibited by applicable law or by the terms and conditions provided herein or in any other manner that could damage, disable, overburden or otherwise impair any server of ours or the network(s) connected to any of our servers or interfere with any other person’s use and enjoyment of the Site; (2) copy, modify or distribute any part of the Site without our explicit prior written consent; (3) use, transfer, reproduce, create derivative works of, display or disclose Site Content (the term as such is defined below), except as expressly authorized herein or as pre-approved by the company in writing; (4) disrupt or attempt to gain unauthorized access to the Site or any part thereof, or the computer system or networks connected to any of our servers, through any means; (5) disable or interfere with the Site’s security features intended to prevent or restrict the use of the Site or the copying of any Site Content; (6) obtain any materials or information through any means not intentionally made available to you through the Site or use any automated system to access the Site; (7) You agree to not use our company website/platform/Application (if any) to collect information about our teaching, testing process and/or to develop strategy, business model, plans, guides and/or any testing preparation materials and/or similar testing or teaching services. 

GLOW Lingual reserves the right to forbid, remove, and/or sustain without delay and without notice to the User, any User content that violates the current Terms and Conditions set in this policy, or to exclude the User and the Student from any further use of the Service, if he or she publishes such content directly or indirectly. 

The User agrees and consents that if, for reasons of unlawful behavior or of any other behavior that infringes the current Terms and Conditions set out in this clause as well as any other document the Service Provider publishes, the User is banned from the Services and the service fee already paid by the User shall not be refundable nor recoverable. 

TECHNICAL REQUIREMENT

To be able to effectively study online classes with our company, the User acknowledges the minimum technical requirements as listed below. Our company will not be responsible for the impossibility of providing the Classes, or poor quality due to the inappropriate or insufficient function of the required devices, software, hardware, internet access on the User’s part. 

MINIMUM TECHNICAL REQUIREMENT TO STUDY WITH US

  • Operating system: Window 7/8/8.1/10, Mac Os X 10.11 and later; for tablets: Android or iOS system
  • The latest stable user version of the Google Chrome Browser and the latest stable user of Zoom application installed, with the setting of automatic updated enabled;
  • RAM:2 GB or higher
  • CPU: dual core processor, min. 1.8 GHz
  • A functioning built-in microphone, headset, and camera;
  • Internet connection: min. 10 Mbit/s

RECOMMENDED TECHNICAL REQUIREMENT TO STUDY WITH US 

  • Operating system: Window 8/8.1/10, Mac OS 10.11 and later; for tablets; Android or iOS system;
  • The latest stable user version of the Google Chrome Browser installed and the latest stable user of Zoom application installed, with the setting of automatic update enabled;
  • RAM 4 GB and/or higher
  • CPU: dual-core processor, min. 2.2 GHz;
  • A functioning built-in microphone, headset, and camera;
  • Internet connection with the speed of min. 35 Mbit/s.

We are not responsible for your equipment not properly. You are responsible for maintaining any equipment that you own that is necessary to use the Services provided by our company. We are not responsible if you are not able to use the services because of your faulty equipment. We will not be liable in any way for any loss or damages which are caused to your equipment.

GLOW LINGUAL ENROLLMENT POLICY

You agree to fully disclose all information relevant to the student’s enrollment in the programs offered by our company. In the event that student information provided is found falsified or is inaccurate, our company reserves full right to terminate the student from any class. 

Our company reserves the right to transfer, suspend and/or terminate the student with immediate effect from any classes in the event that the client and/or the User, student breaches any provisions of the Terms and Conditions, or our company deems, in its own discretion, that the client and/or the User demonstrate behavior that is detrimental to the welfare or safety of the teachers, employees of our company and/or other parents and students of the company, or prejudicial to good order or the reputation of our company, or for any other reason that our company deems fit and proper in its absolute discretion. In the event the student or user is terminated from our company pursuant to this clause, the company will not be under any obligation to return any deposit or fees paid to our company unless otherwise specified elsewhere in this Terms and Conditions. 

There will be no classes held on public holidays. Lessons that fall on public holidays will be postponed to another day in the week. All changes of time and lesson would be notified to all clients, users and parents to make the necessary arrangements. 

THE CLASSES

Trial Class

Our company offers trial classes for new students after signing up on the registration form and following our required process. This trial lesson enables students as well as parents to experience a glimpse of our fun and exciting lessons here at GLOW Lingual.

Trial Class. If at the time set for starting the Trail Class the User is unavailable within the first five minutes, the Teacher may stop waiting for the User, and Trial Class shall be considered to have been held. Our company reserves the right to reschedule or not schedule another trial class in such circumstances. 

Following the Trial Class, GLOW Lingual may recommend a Teacher as well as a Class schedule for the student and parents in accordance with the Student’s proficiency and English levels. 

The User may later request GLOW Lingual to change the Teacher and shall provide the reasons for such request. Our company reserves the right to refuse such requests of the User. 

Selecting a Teacher and Scheduling the Classes 

GLOW Lingual is entitled to reserve time in a Teacher’s schedule for Users based on first come first serve basis (following the queue of parents who have completely registered and made full payment of the class package). 

Class Preparations

Our company advises the Users to follow our class readiness checklist below for the best learning moments.

1.4 Headphone Set will help improve the learning experience and reduce background noise

2.1 A fast and stable internet connection will make for a smooth learning experience

3.Learning Space  

3.1 A quiet learning space with proper lighting and suitable seating will boost student focus during class

Class Scheduling System

The Users can schedule classes weekdays and weekends starting from 9:00 until 20:00 by contacting our customer support staff.

Class Procedures

The class shall start in accordance with the time set in the Class Schedule of the User. The class lasts for 25 and/or 50 minutes depending on the type of learning package and available program offered by the company. In case the User of the Teacher faces technical difficulties during the Class, for example internet connection and get disconnected, they are able to reconnect to the class in the scheduled time frame. 

Classes shall be held in English language and the Teacher is not allowed to use other languages. However, in case the User faces technical difficulties, our staff or student consultant may address the issue to the User in their native language. 

The Class is considered to be conducted properly if the User has not notified our company (the Service Provider) about any complaint against the quality of class within 24 hours from the time of the Class. The company reserves  the right to consider the User’s complaint on an individual basis and, if there are valid reasons, to return the lesson to the User’s Balance. 

The Teacher shall have the right to postpone and cancel Classes, having informed GLOW Lingual in advance. In such a case, a substitute Teacher shall be assigned to the Class. If a substitute Teacher is not found for a Class, the User will be notified by the company and a Class will not be deducted from the User’s Balance. 

Tardiness and Absences from  Classes

If the student or the User is late for the Class or is absent from the Class, the Teacher shall wait for the Students for 25 minutes. The User is entitled to study based on the amount of the remaining schedule timeframe.If the students and/or the User fails to start the Class in this timeframe, this class shall be considered to have been held and shall be deducted from the Balance of the User. However, Classes that cannot be held due to the Teacher’s absences and technical errors shall be extended to meet the scheduled class time frame or rescheduled for makeup classes in the future.  

Suspending the Classes

The User shall be entitled to suspend the scheduled Classes temporarily by contacting our support team. The suspension of the Classes shall be applicable and valid only before the expiry date or deadline set forth in each class package. Once the User, parents and/or student decide to suspend the Class, the Classes scheduled beforehand shall be erased from the Teacher’s schedule making it available for other Users to book and study. However, when the User decides to resume the Classes, the User and the company shall communicate and redetermine the Class schedule together. 

Communication Platform

Communication between the User, the Teachers and the company shall be done via our Platform or designated channel only. Our company shall inform the User about the assignment of Classes, the cancellation of Classes, important announcements etc. via an email and/or other available communication platform of the company. Even though we try our best to provide effective communication; due to the nature of such communications, our company does not guarantee delivery of such messages. 

Class Cancellation & Rescheduling Policy

We strive to provide excellent services and quality online learning experience for the Users. If you have issues with your course or lesson, please contact our customer support team and give us an opportunity to make things right! 

Cancellation or postponement of the Classes by the User of Balance may be arranged not later than 24 hours before the class begins. The User’s failure to meet this deadline shall mean that the User agrees to the proposed time of the Class, and if the Student is absent from such Class,  Payment for it shall not be refunded to the User.

The User acknowledges and agrees that our company reserves the right to not makeup, not refund and is entitled to deduct the class from the total number of hours or class balance that the student is entitled to under the following circumstances:

-The User is absent or does not show up to class due to any reasons and has not notified the staff of the company 24 hours in advance. 

-Technical errors occurred from the User’s side during class and caused the class to not be able to proceed. 

-The User’s class package has already expired from the scheduled time frame. In the case the User’s class package has already expired, the services and the class packages are considered to be provided in full, and the company does not have any obligations to refund the Payment to the User. In this case, the Balance in the User account becomes zero. 

Our company will hold a makeup class with the following cases:

-The teacher is absent for class or late for class and not able to make up for the missing amount of time as scheduled.

-Technical issues or difficulties from our company’s side which caused the learning to stop and that the Teacher and/or the company cannot fix in time. 

Class Packages and Expiry Duration

The private lessons package is valid for up to the following duration from the day of registration. Our 8 class package is valid for up to 1 month starting from the day of registration. Our 24 class package is valid for up to 3 months starting from the  day of registration. Our 48 class package is valid for up to 6 months starting from the day of registration. Our 96 class package is valid for up to 12 months starting from the day of registration.

The Class package is not a recurring Payment construction. It is therefore when the User used all the Classes on his or her Balance, the User will not be able to access the Services until the next payment is made. The User agrees that after the expiry of the class package and there are unused classes/lessons on the User’s Balance, the services under the related class package is considered to be provided in full, and the company does not have any obligations to refund the Payment to the User. Also, in this case of expiry of the class package, the User account balance becomes zero.

Bonus Balance

Every User is able to receive bonus classes into their user account by various methods, including inviting other people, friends and families to join our learning programs. Please note that the paid lessons credits will be consumed first and the free and/or bonus class credits will only be consumed and/or activated after all paid lesson credits within the package have been consumed.

Free and/or bonus class credit has an expiry date, which is shown on the User account. Once the free and/or bonus class expires it will be cleared of any currency and will amount to zero. Also, the amount that was available on the free and/or bonus class credits before cannot be refunded to the User or withdrawn by the User. 

Promotion and Discounts

GLOW Lingual is entitled to provide discounts (hereafter: “Discounts”) and special offer purchases and promotions (hereafter: “Promotions”) to the Users at dates and duration determined solely by the company. The availability and conditions of the Discounts and Promotions shall be indicated  by the company on the Site or on the Platform or on the discount and/or promotion voucher card to inform the Users.

Gifting Classes

GLOW Lingual may provide Gift Classes as a present on different occasions such as but not limited to competitions, special events, etc. For more information about this, please contact our support team.

GLOW Lingual Class Transfer Policy

Class learning packages transfers are allowed under the following conditions:

  1. All class transfers must be notified to our company 2 weeks in advance
  2. Any remaining class balance can only be transferred between different student accounts under the same client account. Transferring of a single week or single class is not allowed.

Paying of your Services:

Users are required to pay the total purchase price of the class package. Users are able to pay the class package by contacting our support team and make the payment to our company’s bank account. 

Pricing: Our class package prices details will be sent to you during the enrollment and/or shown on the Site. 

Invoicing: Should you require an invoice from us, GLOW Lingual only issues an electronic invoice after the Payment of the User, which will be sent to the email address provided by the User at the registration process. 

DISCLAIMERS

To the extent permitted under applicable laws, all the disclaimers will apply regardless of whether the services under the Site are being provided for payment or not. 

The Site is offered “AS IS” and on an “AS AVAILABLE” basis and without warranties of any kind expressed or implied. Our company disclaims any express or implied warranties of merchantability and fitness for specific purpose as well as title or non-infringement. Our company does not guarantee that the Site will be free of security breaches, bugs or virus attacks. The Site may occasionally be unavailable due to upgrades, routine maintenance, etc., and our company is not responsible for timeliness, inaccuracy, unavailability or interruptions in availability, viruses or other defects in the Site or its contents. In no event shall our company be responsible for any damages to third parties or users or their computer systems for any consequence that may result from slow connections, traffic congestion or overload of servers, technical problems of the internet connection or otherwise, even if our company has been informed of the possibility of such damages and without regard to negligence. 

Our company shall not be responsible or liable for any User or content and conduct of any Third Party Website, and the risk of harm or damage in connection with the foregoing rests in its entirety with you.

Our company does not warrant, guarantee or endorse any content included in the User Content posted on the Site, and does not make many warranty or representation with respect to such User Content, and disclaims all liability arising from or related in any manner to the User Content. 

Your access to, reliance on or use of any User Content published on the Site or Third Party Website, or any other interaction you may choose to have with other users of the Site or Third Party Websites, are all at your own risk. Our company is not liable for any claims or damages arising from or related in any way to any dispute which you may have with other users of the Site and/or Third-Party Websites. Although our company has no responsibility or liability with respect to such disputes, our company reserves the right to monitor such disputes, at its sole and absolute discretion.

Except as expressly stated in our Privacy Policy, our company does not make any express or implied warranties or representations of any kind with respect to the security of the information which may be provided by you or collected by the Site in the course of your access and use of the Site and its features. 

EXCLUSION OF WARRANTY, LIMITATION OF LIABILITY

Without  derogating from anything else contained herein, you hereby acknowledge that the entire risk arising out of the use or performance of this site remains with you. Moreover, to the maximum extent permitted by applicable law, GLOW Lingual, its officers, directors, employees, consultants and anyone acting on its behalf, shall not be liable for direct, indirect, special, incidental or consequential damages arising out of the use or inability to use the site, including but not limited to any loss or damage to business earnings, lost profits or goodwill and lost or damaged data or documentation,or inaccurate results, business interruption, or damage stemming from loss of corruption of date or data being rendered inaccurate, the cost of recovering any data the cost of substitute service or claims by third parties for any damages to computers, software, modems, telephone, technical devices and other property suffered by you and/or any entity and/or person arising from and/or related/connected to the use or inability to use the site, even if GLOW Lingual is advised of the possibility of such damages. 

In no event shall the aggregate liability of GLOW Lingual for any and all damages arising from these terms of use or of your use or inability to use the site, shall exceed the total amount paid by you (if any) to GLOW Lingual for using the Site and/or the Services and products offered by the Site during the twelve (12) months period prior to the event resulting in the agreement on our part to pay damages (if any). This is an aggregate limit and the existence of more than one claim hereunder will not increase this limit.  

The User may only use the Services at their own risk and accepts that our company shall not be liable for any material damages or personal infringements arising in connections with the use, apart from the liability for damages caused  deliberately, by gross negligence or criminal offenses, as well as for breaches of contract causing death or injuries to physical integrity or health.

Our company excludes any liability for the User’s or the Student’s conduct. The User and the Student are fully and exclusively liable for their own conduct, including the data and other documents recorded in the Application and on the Website, in such a case, our company shall cooperate fully with the competent authorities to detect infringements.

Our company shall be entitled but shall not be obliged to monitor the content that may be made available by the User in the course of the use of the Services, and the company shall be entitled but shall not be obliged to look for signs or illegal activity with respect to the recorded or photos of the Classes. The User acknowledges and agrees that the company does not assume any obligations or liability for any data which are edited or uploaded by the User.

The User shall be liable to the company for any damages sustained by the company caused by the User’s or the Student’s non-complaint and/or unlawful use of the Services or the Site as well as our social media platform. 

The User acknowledges and agrees to not use the Services provided by the company for any advertising or other promotional or political purposes unless otherwise given consent by our company in writing only.

If the User detects or finds any content which in particular violates the rights or legitimate interests of others, is defamatory, humiliating, abusive, inflammatory, or sexual content and threatens minors etc., he or she shall immediately notify our company. After thorough investigation and found to be true, the company shall be entitled to cancel or modify the information immediately.

Our company shall operate the Services with reasonable diligence and expertise.       We will do our best to ensure the continuous availability of the Services available on the Website and on the Application (if any). However, due to the nature of the Internet, our company cannot guarantee  the continuous operation and the continuity of the Services. The company shall not assume any liability for direct or indirect damages caused by technical shutdown,breaks independent of the company or destructive applications or programs placed by third parties. Furthermore, the company does not assume any liability for any direct or indirect breakdowns, pauses or any other defects, inaccessibility may occur at the service providers (e.g. Google, Apple) used by the company.

GLOW Lingual does not make any further statement and undertakes no further warranties regarding the Services, thus, in particular, it does not warrant that:

  • The User may use the Services without interruption and without error. The user acknowledges and agrees that the company may remove, from time to time, the operation of the Services for an infinite period, or suspend or terminate the operation of the Services for technical, operational reasons at any time, on which, if possible, the company informs the Users;
  • The Services will be free of loss, malfunction, attack, viruses, intervention, interference, hacking or other harmful interference affecting security, which events are considered as Force Majeure events, and for which the company/Service Provider shall in no way be held liable. It is the User’s responsibility to make backups on or from his or her system prior to, during and after the use of the Services, including any content or data used in connection with the Application, the Site, the platform or any social media.

The User agrees to use the Platform and the Services as well as our Application (if any) for the purposes permitted by this Terms and Conditions as well as any applicable law, regulation or generally accepted practices or guidelines in the relevant jurisdictions. Furthermore, the User agrees and warrants that in using the Platform or the Site, the Website and Applications (if any), the actions of the Users shall not and do not contravene the laws, rules or regulations of the country, state, or locality where you reside or the country, the state or locality where the Platform, the Website, the Application as well as where the company is located and operates as well as other restrictions. 

TERMINATION

Our company is entitled to amend the current Terms and Conditions and its integral parts unilaterally at any time. The user shall be entitled to cancel his or her use of our company’s services at any time by sending an email or via any other available communication channels. By canceling the registration or the service, the User’s profile will be terminated and the User therefore cannot have access to class or services provided by our company.

On the occasion that our company detects and becomes aware that the User violates any Terms and Conditions or any in applicable law, the company shall be entitled to unilaterally terminate the Contract with immediate effect. We also reserve all rights to terminate your access and use of the Services immediately at any time and for any reason. The provisions of these Terms and Conditions relating to the protection and enforcement of the company’s proprietary rights, your representations and warranties, disclaimer of representations and warranties, release and indemnities, limitation of liability and types of damages, ownership of data and information, governing law and venue, and miscellaneous provisions shall survive any such termination.

Our company reserves the right, at any time, to update, change or modify these terms and conditions, at our sole and absolute discretion. When we make these updates and/or changes and/or modifications, we will post the revised Terms of Use/ Terms and Conditions on our website/ Site’s homepage. MISCELLANEOUS

The company is entitled to place advertisements or other marketing-related content at any time on the Website or in the Application (if any) as well as any social media platforms.

Hereafter: “GLOW Lingual”, “Company”, “we”, or “us”) collects, stores, uses and discloses personal information from its users and their students website located at glowlingual.com and it’s subdomains (the “Website”), as well as in GLOW Lingual’s mobile application (“Application” if any) operated by the Company including registering an account for your child on the Website (“Registration”) and virtual chatting with GLOW Lingual (“Chatting”). This Policy also contains information about the collecting of the personal data regarding the natural persons who apply as teachers to GLOW Lingual (“Applying as a Teacher”)

The processing and collecting of personal data by GLOW Lingual shall be in harmony with the Thailand Personal Data Protection Act (PDPA). This is for the protection of our students’ and parents’ personal information which has been processed by the company.

WHAT INFORMATION DO WE COLLECT?

  • To contact student’s next of kin in case of emergency
  • To comply with any regulatory, audit or security related requirements
  • To pursue/collect any sums in arrears from parents/guardians
  • To care for the medical needs of students 
  • To process the data for the purpose and on the legal basis 
  • To conduct the background check for Teachers.In order to promote the safety and integrity of the Site and Service provided by our company
  • To share with our affiliates and third parties who provide services on our behalf, which may include website hosting, bank payment, advertising (including but not limited to retargeted advertising), referral (including but not limited to providing information to referring parties) and other services of an administrative nature or educational institutions or affiliated companies, partnered companies or any third-parties who help provide services on our behalf (including but not limited to the coordination of events).

Every teacher providing the services to GLOW Lingual is considered as a data processor (meaning a natural or legal person, public authority, agency or other body which processes personal data). The teachers have access only to the personal data of the children they are teaching in order to minimize the processing of personal data/information.

GLOW Lingual may share certain personal information with its affiliates and/or third party companies and/or contractors that we partner or contract with to provide certain services or reach-outs to you in connection with the Service (or signing up to use the Service). These partners’ collection and use of information is subject to their privacy policies and other terms. You should review such privacy policies and terms.

HOW LONG DO WE RETAIN YOUR PERSONAL DATA?

You may request that we delete the personal information we have collected in connection with you or your child from our records by contacting our company support team. Please note that the request to delete records may lead to termination of your User Account and not allow you to access or use our Services in the future.
